At Multymall, we respect the intellectual property rights of others and expect our users, including vendors, to do the same. This policy outlines how we handle claims of copyright infringement and the steps you should take if you believe your copyrighted material has been used on our platform without permission.
1. Reporting Copyright Infringement
If you believe that content on Multymall infringes upon your copyright, please send a written notice of infringement (a “DMCA Takedown Notice”) to our designated Copyright Agent at the contact information provided below. Your notice must include the following information:
- Your contact details: Full name, mailing address, telephone number, and email address.
- Description of the copyrighted work: Provide a detailed description of the copyrighted work that you claim has been infringed, or if multiple works are involved, a representative list of those works.
- Location of the infringing content: Provide the URL or specific location on the platform where the infringing material is found.
- A statement of good faith: A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement of accuracy: A statement, under penalty of perjury, that the information provided in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.
- Electronic or physical signature: Your physical or electronic signature.
2. How We Respond to Copyright Claims
Upon receiving a valid DMCA Takedown Notice, we will:
- Investigate the claim: Review the provided information and verify its validity.
- Notify the vendor or user: Notify the party responsible for the content in question and give them the opportunity to respond with a counter-notification.
- Remove or disable access: If the claim is found valid, we will promptly remove or disable access to the infringing material.
- Repeat infringers: Users or vendors who repeatedly infringe on copyright laws may have their accounts suspended or terminated at Multymall’s discretion.
3. Counter-Notification by the User or Vendor
If you believe that your content was removed or disabled by mistake or misidentification, you may file a counter-notification with us. Your counter-notification must include the following information:
- Your contact details: Full name, mailing address, telephone number, and email address.
- Identification of the material removed: Provide the URL or specific location where the material was previously posted.
- A statement of good faith: A statement that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Consent to jurisdiction: A statement that you consent to the jurisdiction of the federal court in your location, or if outside the U.S., to the jurisdiction of the federal courts in the location of Multymall.
- Electronic or physical signature: Your physical or electronic signature.
Upon receiving a valid counter-notification, we may reinstate the content unless the original complainant files a court action seeking a legal order to prevent further use of the content.
4. Repeat Infringement Policy
Multymall reserves the right to terminate, suspend, or restrict accounts of users and vendors who are repeat offenders of copyright infringement. A repeat infringer is someone who has been the subject of multiple valid infringement claims or otherwise violates this policy.
5. Limitation of Liability
Multymall, its affiliates, employees, and agents shall not be liable for any damages resulting from the removal of infringing material or from the termination of user accounts in accordance with this policy.
